IMPORTANT: We are a directory and lead generation service only. We do NOT:

Employ any contractors

Perform any home services

Supervise or manage contractor work

Guarantee contractor performance or quality

Control contractor pricing, policies, or business practices

3. HOW OUR SERVICE WORKS

3.1 For Homeowners

When you submit a service request:

Your contact information and project details are shared with qualified contractors who match your service needs and location

Our goal is to connect you with three (3) contractors, subject to contractor availability in your service area

In cases where fewer than three contractors are available or qualified for your specific project, we will provide all available qualified matches

Contractors pay us for access to your information (our service is free for homeowners)

Contractors contact you directly to discuss your project and provide estimates

You make all decisions about hiring and payment independently

All work agreements, payments, and warranties are directly between you and the contractor

3.2 Information Shared with Contractors

When you submit a request, qualified contractors receive:

Your name, phone number, and email address

Project description and timeline

Property location (address or ZIP code)

Budget range (if provided)

Preferred contact times and methods

3.3 Contractor Response Times and Availability

Contractors in our network are encouraged to respond within 24-48 hours when possible

We do not guarantee contractor responses or specific response times

Response times vary based on service type, contractor availability, and project complexity

Some specialized services may have limited contractor availability

Emergency services typically receive faster responses than larger projects

3.4 Service Area and Contractor Availability

We work to connect homeowners with available contractors but cannot guarantee matches

The number of contractors available may vary by service type, location and project complexity

Contractor availability depends on their individual schedules and capacity

We cannot guarantee that contractors will provide estimates or respond to your request

For specialized or complex projects, fewer contractors may be available in your specific area

3.5 Contractor AI Services

IMPORTANT NOTICE: Some contractors in our network use AI-powered services that may:

Answer phone calls when contractors are unavailable and collect your contact information

Respond to text messages automatically using template-based responses

Post automated responses to your online reviews using pre-approved templates

Generate follow-up communications for scheduling and project updates

Your Rights Regarding AI Services:

Contractors using AI services should inform you during interactions

You may request contractors stop using AI for your communications

AI responses are template-based and may not reflect personalized contractor input

AI-collected data (call recordings, messages) is retained for 90 days maximum after contractor service ends

You may request access to or deletion of AI-collected data by contacting the contractor directly

Data Collection by AI Services: When you interact with contractor AI systems, the following may be collected:

Voice messages and call recordings

SMS message content and responses

Contact information and project details

Call timing and response data

4. ESTIMATE AND CONSULTATION FEES

4.1 Estimate and Consultation Fees

Most contractors in our network provide free estimates for standard projects

Some contractors may charge consultation, design, or estimate fees, particularly for:

Complex custom projects requiring detailed design work

Specialized engineering or architectural assessments

Projects requiring extensive on-site evaluation

Contractors are required to disclose any fees during initial contact before scheduling appointments

Estimate Fee Verification: We require contractors to disclose fees during initial contact, but customers should confirm fee policies before scheduling appointments

You have the right to ask about fees before agreeing to meet with any contractor

Estimate fee policies are set independently by each contractor, not by our platform

4.2 Fee Disclosure Requirements

Contractors are encouraged to inform you of any estimate or consultation fees during initial contact

5. HIGH-VALUE PROJECT DEPOSITS

5.1 Contractor Deposits for Large Projects

For projects valued at $50,000 or more, we may require contractors to pay deposits before receiving your contact information:

Projects $50,000-$100,000: Contractors pay $50 deposit

Projects $100,000+: Contractors pay $250 deposit

Commercial Projects: Contractors pay $500 deposit

5.2 Purpose of Contractor Deposits

These deposits:

Ensure serious contractor commitment for valuable projects

Filter out unqualified or uncommitted contractors

Are paid by contractors to us, not by you

Do not affect the pricing you receive from contractors

5.3 Homeowner Payment Responsibility

You never pay deposits to us for any services

All deposits mentioned are paid by contractors to access high-value leads

Your payments for actual work are made directly to contractors

6. USER RESPONSIBILITIES

6.1 Homeowner Responsibilities

Provide accurate, complete information in service requests

Verify contractor credentials, licenses, and insurance independently

Ask about estimate fees before scheduling contractor appointments

Ask contractors if they use AI services and understand how your data will be handled

Make your own hiring decisions based on your research and judgment

Pay contractors directly for any services rendered

Communicate project requirements clearly to contractors

Report any serious issues or safety concerns to our support team

Obtain necessary permits and approvals as required by local law

6.2 Prohibited Uses

Homeowners may not:

Provide false, misleading, or incomplete information

Use the service for illegal activities or requests

Harass, threaten, or abuse contractors or staff

Attempt to circumvent our platform to avoid contractor fees

Post inappropriate, offensive, or harmful content

Submit requests on behalf of minors without proper parental consent

Use information obtained through our platform to contact or solicit anyone under 18

Submit duplicate requests to receive additional contractor contacts

7. CONTRACTOR NETWORK DISCLAIMER

7.1 Independent Contractors

All contractors in our network are independent businesses operating under their own:

Business licenses and permits

Insurance policies and coverage

Pricing and payment terms

Work standards and practices

Legal obligations and liabilities

Estimate and consultation fee policies

AI service usage and data handling practices

7.2 No Employment Relationship

We do not employ, supervise, direct, or control contractors. Contractors are solely responsible for:

Their own work quality and performance

Meeting project timelines and specifications

Obtaining necessary permits and approvals

Maintaining appropriate insurance coverage

Resolving any issues with completed work

Setting and communicating their fee policies

Professional conduct and customer service

Proper disclosure and management of AI services

Obtaining customer consent for AI interactions

7.3 Contractor Verification and Performance

While contractors provide credentials during registration:

We make reasonable efforts to verify basic licensing and insurance information

We track contractor performance metrics including response times, customer satisfaction, and lead conversion rates

Contractors are ranked within their listing tiers based on performance data

Performance rankings are updated quarterly to ensure reliable contractors appear first

We do not guarantee the accuracy or currency of all contractor credentials

Licensing and insurance requirements can change, and verification is ultimately your responsibility

We recommend homeowners independently verify all contractor credentials before hiring

Background checks, detailed license verification, and insurance confirmation remain the homeowner's responsibility

We do not verify or monitor contractor AI service implementations or data handling practices

8. LEAD QUALITY AND GUARANTEES

8.1 Our Lead Quality Commitment

We provide contractors with verified contact information and project details. Our "Lead Quality Guarantee" means:

Accurate Contact Information: We verify phone numbers and email addresses are valid

Real Customer Requests: All leads come from actual homeowners seeking services

Proper Location Matching: Leads are matched to contractors' specified service areas

Project Verification: We confirm basic project details and requirements

8.2 What We Do NOT Guarantee

Our guarantee does not include:

Customer Response Rates: We cannot guarantee homeowners will answer calls or respond to messages

Hiring Decisions: Customers make independent decisions about which contractor to hire

Project Completion: Whether projects will move forward depends on many factors

Pricing Acceptance: Customers may find quotes too high or decide not to proceed

Contractor Selection: You may choose different contractors or decide not to hire anyone

Number of Available Contractors: The number of contractors available varies by service area and project type

AI Service Quality: We do not guarantee the accuracy or appropriateness of contractor AI responses

8.3 Lead Replacement Policy

We provide replacement leads for:

Verified invalid phone numbers or email addresses

Duplicate leads sent in error

Leads outside contractor's specified service area

We do not provide replacements for:

Customers who don't respond or aren't ready to hire

Projects that don't move forward for any reason

Customers who choose different contractors

Leads where customers decide not to proceed

9. DISCLAIMERS AND LIMITATIONS

9.1 No Warranties

We provide our platform "AS IS" without warranties of any kind, including:

No guarantee that the service will be uninterrupted or error-free

No warranty regarding the accuracy of contractor information

No guarantee that estimates will be provided free of charge

No guarantee of a specific number of contractor matches

No warranty regarding contractor AI service accuracy, appropriateness, or data security

9.2 Service Limitations

We cannot and do not guarantee:

Contractor availability or response times

Quality of contractor work or customer service

Completion of projects or adherence to timelines

Resolution of disputes between homeowners and contractors

Specific outcomes from using our platform

That contractors will provide free estimates

That three contractors will be available for every service request

Contractor AI service performance or data handling compliance

9.3 Third-Party Actions

We are not responsible for:

Contractor actions, negligence, or misconduct

Property damage caused by contractor work

Personal injury related to contractor services

Disputes over pricing, payment, or work quality

Contractor failure to obtain proper permits or follow building codes

Contractor fee policies or estimate charges

Work quality, warranties, or guarantees provided by contractors

Contractor AI service data collection, storage, or usage

Customer data privacy violations by contractor AI systems

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY SOUTH CAROLINA LAW:

Our total liability to any user shall not exceed the greater of (a) $500 or (b) amounts paid to us by the user in the preceding 12 months

We are not liable for indirect, incidental, consequential, or punitive damages

We are not liable for personal injury, death, or property loss related to contractor services

We are not responsible for financial losses due to contractor actions or inactions

We are not liable for contractor AI service data breaches, privacy violations, or misuse of customer information

This limitation applies even if we have been advised of the possibility of such damages.

10.1 Privacy and Data Security

We are not liable for:

Unauthorized access to your information due to circumstances beyond our control

Privacy violations or data misuse by contractors who receive your information

Data breaches caused by third-party service providers beyond our direct control

Your voluntary disclosure of personal information to contractors or other users

Data collection, storage, or misuse by contractor AI systems

Privacy violations resulting from contractor AI interactions

This limitation applies in addition to all other limitations specified in this section.

11. INDEMNIFICATION

Users agree to indemnify and hold harmless Anderson SC Home Services Directory, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

Legal disputes between parties

Contractor business practice disputes

Issues with contractor AI services or data handling

Disputes over AI-collected customer data

AI system performance problems or inappropriate responses

Contractor AI regulatory compliance issues

12.3 Reporting Issues

If you experience problems with contractors obtained through our platform:

Minor Issues: Contact the contractor directly first to resolve issues

Safety Concerns: Report serious misconduct or safety concerns to us immediately

Invalid Leads: Contact us if contractor information was incorrect

Legal Disputes: Consult with an attorney for legal matters

Insurance Claims: Contact your insurance provider directly

13. PAYMENT AND FEES

All payments for actual services are made directly to contractors

You are never required to pay us for any service or connection

13.2 Contractor Fees

Contractors pay us fees for leads and platform access

These fees do not affect pricing you receive from contractors

Contractor pricing is determined independently by each contractor

High-value project deposits are paid by contractors, not homeowners

13.3 Estimate and Consultation Fees

Some contractors may charge fees for estimates, consultations, or design work

These fees are set and collected independently by contractors

We do not receive any portion of estimate or consultation fees

Fee policies vary by contractor and project type

14. PRIVACY AND DATA HANDLING

14.1 Information Collection

We collect information necessary to provide our matching service, including:

Contact information (name, phone, email)

Project details and service requirements

Location information for contractor matching

Communication preferences

Budget ranges when provided

Voice messages and call recordings when you contact contractors using AI phone answering services

SMS message content when texting contractors with AI messaging systems

14.2 Information Sharing

We share your contact information and project details with:

Qualified contractors who match your service needs and location

Our support team for customer service purposes

Third parties only as required by law or legal process

AI systems used by contractors for call handling, messaging, and automated responses

14.3 Data Security

While we implement reasonable security measures:

We cannot guarantee absolute security of your information

Users assume risk associated with sharing personal information online

We cannot control data security practices of contractor AI systems
